Terms of Use

Article 1 – Purpose

These Terms define the conditions of access to and use of the Site, which offers a personalized poster generation service using artificial intelligence, as well as the sale of pre-generated city posters.

Article 2 – Access to the Service

Access to the Site is free. Personalized poster generation is limited to 1 generation without an email, then 20 additional generations after entering a valid email address.

Each order placed adds 100 additional generation credits, cumulative, to the account associated with the customer's email address.

Even when an offer provides extended or uncapped access, such access is strictly reserved for normal, personal, and non-abusive use of the service. Abusive use includes, but is not limited to, any abnormally excessive use relative to the purpose of the service, any use intended to circumvent the economics of the offer, any massive solicitation of the infrastructure, and any automated or semi-automated use. In the event of abusive use, SWISH LIVE may suspend access, limit the number of generations, or terminate the service, without refund in case of user fault.

SWISH LIVE reserves the right to suspend or interrupt access to the Site at any time, particularly for maintenance, updates or force majeure, without this giving rise to any compensation.

Article 3 – Registration and Email

Using the generation service beyond the initial quota requires entering an email address. This address is used solely for the purposes described in our Privacy Policy.

The user agrees to provide a valid, personal email address. SWISH LIVE reserves the right to block any account associated with fraudulent or abusive use.

Article 4 – Use of the AI Generation Service

The generation service uses artificial intelligence to transform photos uploaded by the user into personalized posters.

The user agrees not to upload content that:

• infringes the intellectual property rights of third parties (logos, protected characters, trademarks, etc.);
• is illegal, defamatory, discriminatory, violent or pornographic;
• depicts minors inappropriately;
• is generated with the intent to deceive, harm or impersonate others.

SWISH LIVE reserves the right to refuse image generation if the submitted content violates these Terms or the terms of use of the underlying AI technologies.

Article 5 – Intellectual Property of Generated Content

Posters generated by the service are created from the combination of the photo provided by the user and artificial intelligence models operated by SWISH LIVE.

The user is authorized to use generated posters for personal, non-commercial purposes (printing, sharing, decoration).

Any commercial use (resale, reproduction for profit, large-scale distribution) of generated posters is prohibited without prior written consent from SWISH LIVE.

SWISH LIVE retains the right to use generated posters for promotional, illustrative or service improvement purposes, subject to anonymization of personal data.

Article 6 – User-Uploaded Content

The user warrants that they hold all necessary rights to the photos and content they upload to the Site.

By uploading a photo, the user grants SWISH LIVE a temporary, non-exclusive, royalty-free license to process the image solely for poster generation purposes.

Uploaded photos are automatically deleted after poster generation. SWISH LIVE does not retain users' original photos.

Article 7 – Liability

SWISH LIVE makes every effort to ensure the proper functioning of the Site and the quality of the generation service. However, SWISH LIVE does not guarantee that the service will be error-free or uninterrupted.

SWISH LIVE shall not be held liable for any direct or indirect damages resulting from the use or inability to use the Site.

In particular, SWISH LIVE cannot be held liable for AI generation results, as these depend on the quality of the photo provided and the inherent unpredictability of artificial intelligence technologies.

Article 8 – User Conduct

The user agrees to use the Site in accordance with its intended purpose and not to:

• attempt to circumvent the technical limitations of the service (quotas, security);
• use automated systems (bots, scripts) to access the service;
• disrupt the operation of the Site or associated servers;
• collect personal data from other users.

Any violation may result in immediate suspension of access to the service.

Article 9 – External Links

The Site may contain links to third-party websites. SWISH LIVE is not responsible for the content or privacy practices of these sites.

Article 10 – Changes to the Terms

SWISH LIVE reserves the right to modify these Terms at any time. Changes take effect upon publication on the Site.

Continued use of the Site after modification of the Terms constitutes acceptance of the new conditions.

Article 11 – Applicable Law and Disputes

These Terms are subject to French law.

In case of dispute, an amicable solution will be sought first. Failing that, the courts of Montpellier shall have sole jurisdiction.
